ABSTRACT
One of the mandatory conditions for Armenia’s accession to the World Trade Organization (WTO) was the adoption of the Law “On the Protec-tion of Economic Competition.” However, it was adopted only on No-vember 6, 2000, and entered into force on December 15 of the same year (05.12.2000, HO-112). The adoption of the Law also implied its alignment with international agreements, particularly the “Partnership and Cooperation Agreement” between the Republic of Armenia, the European Union, the European Atomic Energy Community, and their member states, signed on April 22, 1996, and entered into force on July 1, 1999.
As a member of the CIS and the Eurasian Economic Union, Armenia is also obliged to harmonize its competition protection legislation with the legal frameworks of these organizations. This is evidenced by the Eu-ropean Commission’s notice on market definition (97/A.372/03), the CIS Agreement “On Coordinated Antimonopoly Policy” (January 25, 2000), and the Decision of the Supreme Eurasian Economic Council “On the Model Law on Competition” (October 24, 2013, No. 50, Minsk).
The state authority responsible for regulating economic competition has had both achievements and shortcomings. Over time, the Law has un-dergone 27 amendments and additions, which have had both positive and negative impacts on the body’s performance.
The purpose of this study is to analyze the activities of this authority during different periods, highlight its positive results, identify functional and legislative shortcomings, and draw the attention of governmental bodies and lawmakers to the conclusions presented.
